Lewes District Council (Alcohol Consumption in designated Public Places) (No 1) Order 2009

Lewes District Council is working in conjunction with the police on implementation of a Designation Order (The Order) that will prohibit the drinking of alcohol in public places within the area outlined on the attached plan.


This area has been identified by the police as an area where the public consumption of alcohol is associated with disorder, nuisance/annoyance to members of the public frequenting the area and/or local residents.


The effect of the Order


The Order will give the police the power to stop any person consuming alcohol within the designated area and confiscate any alcohol that is found in that person's possession. It is important to emphasise, however, that the police would exercise such powers with discretion and only target those persons who were:


I. drinking in the designated area, and


II. causing disorder or a nuisance or annoyance to others.


Public drinking within the designated area would not automatically, therefore, attract the attention of the police.


Failure to comply with the Order


Any person who fails to stop consuming alcohol in the designated area or refuses to hand over the alcohol when required by the police commits an offence and is liable on conviction to a maximum fine of £500.00


The effect on licensed premises

By virtue of the Criminal Justice and Police Act 2001, any premises which hold a premises licence or a club premises certificate authorising the supply of alcohol within the curtilage of such premises is excluded from the effect of the Order.


Representations

Any representations about the proposed Order should be made in writing to the District Solicitor, Lewes House, 32 High Street, Lewes. East Sussex BN7 2LX and be received before 4 pm on Monday 17 October 2009.


When the consultation period has expired, the Order will be considered by Council along with any representations that have been received.



No Cold Calling


Consultation for Ringmer

East Sussex County Council's Trading Standards Service is working with Ringmer Parish Council to set up this scheme, of which several have already been successfully established in East Sussex. We want to stop unwanted callers and bogus traders from operating in the area and now we need to know what local people think about the proposal.


This public consultation was held between 9 March and 10 April 2009. During this time you were strongly encouraged as residents, businesses and organisations in the Ringmer area to ask questions and give your views. You may for instance have commented whether any organisations, such as charities, should be exempted from these measures and to what extent.


Setting up a zone is a warning to cold callers and bogus traders to keep out. Community safety is one of the County Council's top priorities and that is why Trading Standards are supporting this proposal. A no cold calling zone would offer more protection against unwanted callers which would benefit local residents, especially older and vulnerable people in the area


If local people approve the plans, a launch date will be organised and further information will be made available to residents; information packs will also detail basic measures to protect against doorstep crime and improve home security. Signs will go up at the entry and exit points of the major roads in and surrounding Ringmer to ensure cold callers get the message that they are not welcome in the area.
